British Citizenship/Passport Applications

There are six types of British nationality:

British Citizen
British Overseas Citizen
British Overseas Territories Citizen
British National(Overseas)
British Subject
British Protected Person

British Citizen is by far the best and strongest status and, unlike the other types, confers an unfettered right of abode in the UK. Below we will only discuss British citizenship, not the other types of British nationality, which are generally less important.

Some people are British from the moment of birth and some not, and in some cases, it is difficult to work out whether they are or not. It is important to know that a person who was born in the UK before 1 January 1983 is certainly a British citizen. A person born in the UK on or after that date might or might not be, depending on the status of their parents. And a person born outside the UK will acquire British citizenship from a British parent if the parent is British “otherwise than by descent,” as opposed to British “by descent” (see below). But the child will be born British by descent.

A person who is not born British may be able to subsequently acquire British citizenship, either by way of naturalisation or registration.

    British Naturalisation Application

In most cases, adults (aged 18 or over) seeking British citizenship must apply for naturalization. Requirements include sound mind, intention to make the UK their home, lawful residence in the UK for a specific period (three or five years), possession of settlement, limited time spent outside the UK, meeting English language and Life in the UK Test criteria, and having no disqualifying criminal issues.

    British Registration Application

Children can apply for British citizenship through registration, which has more flexible rules than naturalization. The outcome can depend on parental status and family intentions to live in the UK long-term. English language requirements are not applicable for registration, but adults need to attend a citizenship ceremony. Registration often grants British citizenship otherwise than by descent, but it might confer British citizenship by descent in certain situations.

    British Passport Application

A British citizen can apply for a British passport through HM Passport Office, distinct from the Home Office, as it’s an administrative, not immigration, process.
